Each and every day those of us with children trust someone else to protect our children and family. Whether it be a friend, a teacher or in this case a school bus driver. We expect those entrusted with our most precious cargo to have a higher level of responsibility than normal. Unfortunately this did not happen recently in Anderson, South Carolina when a school bus failed to yield the right of way while attempting to make a left hand turn. According to WYFF News 4, Phillip Osborne of Anderson was operating a school bus when he attempted to make a left hand turn in front of an oncoming Jeep Cherokee. According to the police, Phillip Osborne was cited with failing to yield the right away. As a result of this negligence, two teenagers were sent to Anderson Area Medical Center (AnMed) with injuries from this bus accident. The driver of the Jeep was not injured.
County and State School Bus Accidents Unique
In most accidents in South Carolina you have 3 years to file a lawsuit. However, when a government entity, which also includes a school district, has an employee that causes an accident then you only have two years to file a lawsuit if need be. In addition, the injured teenagers and their families could not bring a lawsuit against the bus driver personally. Finally, the damages would be capped at $600,000 for this accident regardless of the nature of their injuries. These provisions are knows as the South Carolina Tort Claims Act.
South Carolina Tort Claims Act May Require An Attorney
In these type of cases, it can be challenging for an injured person to protect their interests and receive the proper compensation without using an experienced accident lawyer. There are often multiple parties or injury victimes all trying to justify their rights to a limited pool of compensation to cover their injuries. Often this is not enough to cover all the injuries as we saw in the miniature train wreck in Spartanburg, SC a couple of years ago.
