South Carolina DUI Charges
In South Carolina there are several alcohol related offenses but the two most common are driving under the influence (DUI) or Driving With an Unlawful Alcohol Content (DUAC).
South Carolina DUI means that a person is driving within the while their physical and mental abilities are materially and appreciably impaired by alcohol and/or drugs. This would apply to prescription drugs as well. It does not mean the person is drunk driving but instead refers to a person being impaired.
South Carolina DUAC Charges
A DUAC differs from a DUI in that it does not require proof of being impaired. What must be shown here is that the person accused of drunk driving had a BAC (blood alcohol concentration) of .08 or more. There is always the question of whether or not a person should take a breathalyzer test. In South Carolina a person who refuses to provide a breath or blood sample cannot be convicted of DUAC because there was no proof of blood concentration.
