INSURANCE BAD FAITH
A person that has insurance has a contract with that insurance carrier. When the insurance carrier fails to pay a claim that is covered or should have been paid under that policy then the insurance carrier has breached that contract. This is referred to as insurance bad faith. The South Carolina Courts realize that the damages for breach of contract are not adequate to compensate the policy holder so an insurance bad faith claim is permitted especially in cases of reckless or poor conduct on the part of the insurance carrier. You pay for these policies for years and then when you finally submit a claim, the claim is denied without explanation and without justification. We see these denials in some of the following areas:

- Automobile Claims
- Life Insurance Claims
- Property Damage and Home Owner Claims
- Special Medical Condition Policies (Cancer, Alzheimer’s, etc.)
